General booking conditions

Introduction

These general conditions apply to bookings processed through the website https://casapazos.es (hereinafter, the WEBSITE) and constitute a contract between You (hereinafter, the CLIENT) and:

Through our online booking service, the CLIENT is contracting a tourist accommodation booking, subject to these general conditions of contract, which aim to regulate the contractual terms for booking the services offered by CASA PAZOS through the WEBSITE.

The request and processing of bookings on this WEBSITE imply the full and unconditional acceptance of the prices offered and of these general conditions of contract in their latest version. For this reason, it is recommended to read these conditions before requesting or formalising your booking and each time you access our WEBSITE, since CASA PAZOS reserves the right to modify, add or delete all or part of these general conditions at any time.

Legal regulation

These general conditions are subject to the provisions of Law 7/1998, of 13 April, on General Contracting Conditions, the Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other supplementary laws, Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, as well as all regulations on tourism or that regulate any aspect of tourist accommodation and that are applicable, and subsidiarily, the Civil Code and the Commercial Code.

Clauses

The formalisation of bookings through the WEBSITE is subject to the following clauses:

First.- Declarations

The CLIENT declares:
a) To be of legal age and to have full capacity to formalise the booking, declaring that they understand and fully comprehend all the conditions set out on the WEBSITE.
b) That the data provided when formalising the booking are true and complete.
c) That they confirm the requested booking and, in particular, the indicated dates and number of persons.
d) That they commit to complying with the specific rules of the tourist establishment.

Second.- Access to the website

Access to the WEBSITE is the responsibility of the CLIENT.

Third.- Booking

  1. The booking includes the services detailed according to the conditions of the rate stipulated on the page from which the booking is requested or formalised. These specific conditions must be accepted by the CLIENT together with these general conditions before formalising the booking. The contract may be validly formalised in any of the languages available on the WEBSITE, with the Spanish version prevailing in case of discrepancies between the translated versions.

  2. The CLIENT accepts that CASA PAZOS assumes no obligation or responsibility with regard to those services not provided directly, and in particular, regarding the lack of truthfulness, incompleteness, lack of updating and/or inaccuracy of the data or information about prices, offers, characteristics, and any relevant information regarding products or services from external providers that are advertised or could be booked through the WEBSITE. Likewise, CASA PAZOS is exempt from any liability arising from the non-fulfilment or defective fulfilment by such providers of the obligations arising from the service contract signed or from the regulations in force.

  3. Online bookings: The process of formalising online bookings follows the steps detailed below:

  • Step 1. Booking: Selection of available dates for staying at the establishment and choice of room and rate type (non-refundable or standard).

  • Step 2. Entering identification and contact details.

  • Step 3. Payment: Payment by credit card through the Stripe platform. You will be asked for your card number, expiry date and CVC code.

The store uses a server based on standard SSL (Secure Socket Layer) security technology. All the information you transmit travels encrypted over the network. Likewise, your credit card data are not stored in any database but go directly to the POS (Point of Sale Terminal of the Bank).

When paying by card you may be asked for the following details: Cardholder’s name, card number, expiry date, and a Validation Code which corresponds to the last 3 digits printed in italics on the back of your card, thus offering more guarantees regarding the security of the transaction.

Once the booking is made, a confirmation will be sent by email to the contact address provided by the CLIENT.

  1. At each step of the booking process, any errors in the entry of data may be corrected by using the “back” button of your browser. Likewise, the booking confirmation email will summarise the booking details. In case of detecting errors, users must immediately request the appropriate corrections from CASA PAZOS by sending an email to: info@casapazos.es

Fourth.- Price and payment

  1. The conditions, the price of the services and the accepted methods of payment are those expressly determined on the page where the CLIENT makes the booking.

  2. Unless otherwise specified, the prices indicated on the WEBSITE are Retail Sale Prices (RRP), including VAT. The transaction will be carried out in EUROS regardless of the CLIENT’s origin.

Fifth.- Modification and cancellation of the booking

As long as the standard (refundable) rate has been chosen, in case of cancellation or modification of the booking – for any reason – the following percentages will be withheld from the amount of the advance payment made:

  • Cancellations will be free of charge provided they are made up to 3 days before the first day of booking.

  • Once the cancellation deadline has expired, 100% of the amount paid will be retained in the case of one-night bookings.

  • In the case of bookings of several nights, once the cancellation deadline has expired, 100% of the amount paid equivalent to the first night and 50% of the amount of the second night will be retained.

The cancellation or modification of the booking will not entail any cancellation fee as long as it is made more than 3 days in advance, unless otherwise specified in the conditions of the rate stipulated on the page from which the booking is formalised. Any bank charges that may result from the cancellation of the booking payment will be borne by the CLIENT.

The request for modification or cancellation may be made by email sent to info@casapazos.es, always indicating the booking reference.
The success of the modification will depend on the availability of the accommodation at the time of the request.
In case of no-show at the establishment, the accommodation will charge the full amount of the booking.

Sixth.- Right of withdrawal

For the purposes provided for in article 97.i) TRLGDCU, you are informed that, pursuant to article 103.l) of the aforementioned regulation, the CLIENT has no right of withdrawal.

Seventh.- Nullity of the clauses

If one or several of the clauses included in these general conditions were declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part of it declared as such, with the general conditions subsisting in everything else. Such provisions or the parts of them affected by their nullity or ineffectiveness shall be deemed not to have been included.

Eighth.- Acceptance

The request and formalisation of the booking necessarily imply that all and each of these general conditions, considered as an integral part of the booking and completed with the conditions of the rate and the specific applicable legislation, are expressly accepted by the CLIENT.

Ninth.- Applicable law and competent jurisdiction

These general conditions and the service provision contract signed between CASA PAZOS and the CLIENT shall be governed by Spanish law. Without prejudice to the rights recognised to consumers regarding jurisdiction under the TRLGDCU, any dispute that may arise from the use of the WEBSITE or from the services linked to it shall be submitted to the jurisdiction and competence of the Courts corresponding to the domicile of CASA PAZOS.
